1. Agreement to Terms

By accessing or using Blink Marketplace, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Blink Marketplace regarding your use of our platform, including our website, mobile applications, and auction services.

2. Auction Participation & Bid Commitments

Blink Marketplace operates a high-trust, commitment-based auction system. To ensure the integrity of our marketplace:

Bid Commitment Deposit: All participants in an auction must provide a Bid Commitment Deposit (typically 5% of the starting price or a flat fee) prior to placing a bid.
Enforcement: By placing a bid, you enter into a legally binding contract to purchase the asset if you are the winning bidder.
Default & Forfeiture: If a winning bidder fails to complete the transaction within the specified timeframe (usually 48-72 hours), the Bid Commitment Deposit will be forfeited and paid to the seller and the platform as a penalty for default.

3. Seller Obligations

All sellers on Blink Marketplace must be verified. Sellers are responsible for:

Providing accurate, honest descriptions and high-quality imagery of assets.
Ensuring assets are available for inspection as described in the listing.
Paying a 10% transaction commission upon successful sale of an asset.

4. Payments & Fees

Blink Marketplace charges fees for platform usage:

Commission: A 10% commission is charged on all successful sales.
Verification Fees: Brands and sellers may be charged a one-time or recurring verification fee.
Subscriptions: Streamers and creators may be required to maintain a subscription to host auction rooms.

5. Dispute Resolution

In the event of a dispute between a buyer and seller, Blink Marketplace provides a structured dispute framework. Both parties agree to participate in good faith in our mediation process. Our liability is limited as specified in our liability section.

6. Limitation of Liability

Blink Marketplace provides the platform as a service. While we verify sellers and implement protection mechanisms, we are not responsible for the ultimate quality or condition of the assets, which must be verified during the inspection period.
